Terms of Use

The rules for using the Love Your Bus Stop app, public map and admin platform.

1.Acceptance

These Terms of Use (“Terms”) govern your use of the Love Your Bus Stop iOS app, the public colour-coded map, the admin dashboard at admin.loveyourbusstop.co.uk and the client portals operated under it (collectively, the “Service”). By creating an account, signing in, or submitting a survey, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Service.

2.About us

The Service is operated by Transport Made Simple Ltd, registered in England and Wales under company number 15754458, with its registered office at Roswold House, Oak Drive, Diss, England, IP22 4GX. References in these Terms to “we”, “us” and “our” are to Transport Made Simple Ltd.

3.Eligibility

You must be at least 16 years old to create an account or submit content. If you are between 13 and 16 you must have permission from a parent or guardian. The Service is not intended for children under 13.

4.Your account

4.1 Registration

To survey bus stops, earn points and redeem rewards you need to create an account using your email address and a password, or by signing in with Apple. You must provide accurate registration information and keep it up to date.

4.2 Security

You are responsible for keeping your account credentials secure and for all activity carried out under your account. Notify us immediately at contact@central-connect.co.uk if you suspect unauthorised use of your account.

4.3 One account per person

Each person may hold a single public account. Operating multiple accounts to claim points or rewards more than once is a breach of these Terms and may result in points being removed and your account suspended.

5.What the Service is — and isn't

The Service exists so that members of the public, TMS field staff and our council clients can collaboratively map and improve bus-stop infrastructure across the regions we cover. Aggregate ratings and statuses are shown publicly; individual survey detail is private to you and to authorised TMS staff and our council clients where relevant.

The Service is not a real-time bus information system, an emergency reporting channel, or a substitute for contacting your local authority about urgent road or safety issues. For accidents, anti-social behaviour or urgent safety risks please contact the police or the relevant authority directly.

6.Acceptable use

You agree that you will not:

  • Submit a survey for a stop you have not personally observed.
  • Knowingly submit false, misleading or inaccurate information about a bus stop.
  • Upload photographs that infringe anyone’s copyright or other rights, or that you do not have permission to share.
  • Upload photographs that identify private individuals where you have not obtained their consent, or that depict children in a way they (or their parent/guardian) have not consented to.
  • Upload content that is unlawful, threatening, harassing, defamatory, obscene, discriminatory or otherwise offensive.
  • Impersonate anyone else, including TMS staff, council officers or another user.
  • Attempt to access, probe or interfere with parts of the Service you are not authorised to use, or to bypass any access controls.
  • Use automated systems (scrapers, bots, crawlers) to interact with the Service in a way that places unreasonable load on it.
  • Sell, transfer or attempt to monetise points, rewards or your account.

We may remove any content, deduct points or suspend any account at our discretion where these Terms are breached.

7.Your submissions and content

7.1 Licence you grant us

You retain ownership of any survey content and photographs you submit. By submitting content to the Service you grant us a non-exclusive, worldwide, royalty-free, sub-licensable and irrevocable licence to host, store, display, use and adapt that content for the purposes of operating, improving and promoting the Service, including sharing aggregate ratings and necessary underlying data with our council clients under our contracts with them.

7.2 Your warranties

You confirm that you have the right to submit each piece of content, that it does not infringe anyone else’s rights, that it is your genuine observation of the bus stop concerned, and that it complies with section 6.

7.3 Moderation

We may, at our discretion and without notice, remove content (including photographs) we consider in breach of these Terms or otherwise unsuitable. Where we delete a survey, the affected bus stop is re-rated from the next most recent remaining survey, or reset where none remain.

8.Points and rewards

Points are awarded for accepted survey submissions and may be redeemed for the rewards listed in the app from time to time. The following terms apply:

  • Points have no cash value, are not transferable, cannot be exchanged for cash and may not be combined across accounts.
  • Reward availability is subject to stock and may be limited by region (for example, certain freebies are only available in specific towns).
  • You must provide accurate delivery details (name, postal address, phone, email) for any reward we send by post. We are not responsible for non-delivery caused by inaccurate details.
  • We may refuse or refund a redemption at our discretion, for example where the reward is out of stock, where the request was caused by an error, or where we believe the account has breached these Terms.
  • We may adjust point thresholds, reward tiers and geographic restrictions from time to time. Existing point balances are not affected by future changes to the reward catalogue.

9.TMS operative accounts

Accounts with the “operative” role are issued only to authorised TMS field staff. If you have an operative account, you may use it only in connection with your assigned duties, you must keep your access credentials confidential, and you must comply with any additional internal policies in force from time to time. Misuse of an operative account may result in disciplinary action.

10.Council client portals

Council client accounts (e.g. Norfolk County Council, Essex County Council) are provided under our service agreements with the relevant authority. Council users may view information scoped to that authority only and may not access, share or publish content outside the scope of their agreement with us.

11.Intellectual property

The Service, including its design, source code, branding, the “Love Your Bus Stop” name and the “Transport Made Simple” name and logo, is owned by us or our licensors and protected by intellectual property laws. Nothing in these Terms transfers any of those rights to you.

Bus stop location data is supplied under the UK Department for Transport’s NaPTAN and Bus Open Data Service feeds and is reused under the Open Government Licence v3.0. Aggregate ratings and statuses we publish on the public map are our own work and we make them available to council clients under separate arrangements.

12.Availability and changes

We provide the Service on a reasonable-efforts basis but do not guarantee that it will always be available or free of errors or interruptions. We may add, change, suspend or remove features from time to time without notice. We will give you reasonable notice of material changes that materially affect you where we can.

13.Disclaimers

Except where required by law, the Service is provided “as is” without warranty of any kind. We do not warrant that the colour-coded ratings, status flags, bus service lists or any other data shown are complete, accurate or up to date — they reflect the most recent crowd-sourced and operator data available to us.

14.Limitation of liability

Nothing in these Terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be excluded under English law.

Subject to that, we will not be liable to you for any indirect or consequential loss, loss of profits, loss of revenue, loss of business, loss of data, or wasted expenditure arising from your use of the Service. Our total aggregate liability arising in connection with the Service is limited to £100.

15.Termination

You may stop using the Service at any time and ask us to delete your account by emailing contact@central-connect.co.uk.

We may suspend or terminate your account where we believe you have breached these Terms, where your account has been inactive for an extended period, or where we discontinue the Service. On termination, sections that by their nature should survive (including content licence, intellectual property, disclaimers and limitation of liability) will continue to apply.

16.Changes to these Terms

We may update these Terms from time to time. The “Last updated” date at the top of this page shows when they were last revised. Where changes are material, we will give you reasonable notice in the app or by email. Continued use of the Service after the changes take effect means you accept the updated Terms.

17.Third-party links and services

The Service may link to or rely on third-party content (for example, the OpenStreetMap base map). We are not responsible for the availability or content of those third-party services. Your use of them is at your own risk and subject to their own terms.

18.General

If any part of these Terms is found to be unenforceable, the rest will remain in force. Our failure to enforce any right or provision is not a waiver of that right or provision. You may not assign or transfer these Terms; we may assign them to a successor or affiliate.

19.Governing law and jurisdiction

These Terms and any dispute or claim arising out of or in connection with them are governed by the laws of England and Wales. The courts of England and Wales have exclusive jurisdiction to settle any such dispute, except that if you live elsewhere in the UK you may bring proceedings in the courts of your home nation.
